Definitions

The following definitions will apply to these Terms and Conditions:

  • “Company”/”Ria Overseas”/”We”/”Us”: Ria Overseas Pvt. yes, have been incorporated and registered under the provisions of the Companies Act.
  • “Student”/”Parent”/”You” means an individual who has registered with the Company for enrollment counseling services, along with their parents or legal guardians.
  • e) “Services” means the advertising and marketing services, consultation & assistance; documentation service, permit application provides and support offered by Company for MBBS/MD/MS/BDS/BVSC/BAMS admissions in India and abroad.
  • “University” / “Institution”: means a Medical College or University in India or abroad where admission is applied/available for, on behalf of the Student.
  • The term “Service Fee” / “Consultancy fee means all fees, paid by the Student/Guardian to Company for availment of Services — registration fee, processing fees and service charge.
  • “Agreement” means these Terms and Conditions, the Registration Form and any Affidavit executed by the Student and/or their parents/guardians.

Acceptance of Terms

Registering with Ria Overseas Pvt. By accessing the Site, using Contests and/or making any payment in relation to Services, the Student and their parents / guardians (collectively referred to as the “Parent”) agree that they have read, understood and unconditionally agreed to be bound by these Terms and Conditions.

These terms are the entire agreement between the parties and replace all prior understandings, representations or agreements whether written or oral.

Scope of Services

3.1 Services related to MBBS/MD/MS/BDS/BVSC/BAMS in India

The Company will perform the following functions for medical admissions in India:

  • Details of Medical Colleges in each state: Seat Matrix, Year of Establishment, Fees/ Dues structures, Cut-Off details and Service Bond information.
  • NEET Counselling : Get 24×7 alerts for NEET Counselling and Admission related dates & instructions on Telegram, WhatsApp and Voice Call.
  • NEET Score vs MBBS Budget: NEET score based analytical for better fit in Student’s budget with the best-in-class Academic learning and Clinical exposure.
  • Personal Counsellor: Personalattle orientated, with a three-story support centre and conversation approach directly with Company Directors.
  • Counselling (MCC & State): Full Year Support for Form Filling / Registration, Document Verification, Choice Filling, Seat Allotment and College Reporting.
  • Upgradation of Colleges: Help in upgrading from Round 1 to Round 2 counselling.
  • Full NEET Counselling assistance from Round 1 to Round 3 and Stray Vacancy Round Updates.
  • Govt. Data ORM: / Mgmt. / NRI Quota: Assistance for admissions to Government Colleges, Private Colleges and Deemed Universities.
  • Refund procedures for security amount: Help tracking of balances in respect of counselling.

3.2 Services for MBBS/MD Abroad

Company shall be providing the following services for international medical admissions:

  • Country & University Studies: As per Student profile and wallet
  • Support with Entrance Exam & Interview.
  • Help with the Admission letters & Invitation Letters.
  • Subtlety of documents: MEA5 PhD Verification and Diploma Translation
  • Expedited Visa Process and Flight Reservation.
  • Airport Drop & Pre-Departure Briefing
  • Education Loan Assistance and Bank Loan documentation support.
  • Government Agencies NOC
  • Numerous Levels in Health, Health & HIV Certificates
  • Help with Police Clearance Certificate.
  • Assistance with Forex Exchange & Remittance Fee.

Post-Departure Services:

  • Help with Immigration Clearance on arrival.
  • Travel assistance from Airport to University.
  • SIM Card and Bank Account Opening Assistance.
  • Help in hostel allotment and accommodation booking.
  • University Registration and contract sign assistance.
  • Issuance Support of Student ID, Hostel Card and International Student Card
  • Embassy bills.
  • VISA Renewal Assistance and Medical Insurance Assistance
  • Coaching for USMLE and PLAB.
  • Unmatched support for all 5 years of the course, through licencing exams and post graduate admissions.

3.3 Exclusions

The following are specifically excluded from the scope of Services and the Students/Guardian is solely responsible for:

  • Tuition Fees: The same shall be paid to University Formation by payment made directly from Student or Parent in the Universities bank account.
  • Hostel Fees: Directly Paid to University on Arrival.
  • Living Expenses: Food, Traveling, Clothing, etc.
  • Counseling Registration Fees– Payable to Government portals (AIQ/State) and must be directly paid by the Student/ Guardian.
  • Hotel/Accommodation Reservations: For traveling with the parents and other companions.

4. Service Fees and Payment Terms

4.1 Service Fee Structure – MBBS/MD/BAMS/BDS in India

The following fees are applicable for admission services within India (exclusive of 18% GST):

MBBS – NRI Quota Rs. 3,00,000
BDS/BVSC/BAMS Rs. 50,000 – 1,00,000
MBBS Abroad Rs. 75,000 – 2,00,000

Important: The above fees do not include AIQ/State/Deemed/NRI Quota counseling registration fees to be paid by the candidate through their own bank account.

4.2 Payment Terms

  • All Service Fees are payable as per the terms discussed during admission.
  • Payments are made by bank transfer/demand draft/ cheque or credit card in favour of “Ria Overseas Pvt. Ltd.”
  • All the fees are mentioned exclusive of 18% GST which shall be paid additionally by the Parent.
  • After securing admission to a medical college, the Post-dated cheques submitted by the Parent will be encashed by the Company. The Parent is entirely responsible for ensuring sufficient funds remain or are held in the relevant bank account of the Holder on the date of the cheque.
  • Payment shall be governed by the Refund Policy in Section 5 of this Agreement.

Refund Policy

(NO LONGER ACHIEVED) IMPORTANT: SERVICE FEEMONEYPAIDTO RIAOVERSEASPVT. Distributor shall be under no obligation to issue any such refund and all purchase orders submitted by or on behalf of you reflect in each case that the amounts paid to Distributor are final and non-refundable — which is acknowledged as being reasonable, proper and appropriate by you. BY PAYMENT, THE PARENT ACCEPTS THIS POLICY WITH NO EXCEPTIONS

5.1 General Non-Refundability

Any and all registration fees, service charges, processing fees, and other sums paid to the Company are not refundable once paid for any reason whatsoever (whether or not valid);

  • An offer from another university · The Student’s change of mind, preferences or withdraws/admires for the admission process
  • The Student could not qualify NEET or any other admission related entrance.
  • Student NOT getting Admission for ANY reason
  • Development of Government policy, NMC guidelines or regulation by Universities.
  • Any events of force majeure such as natural disasters, pandemics, war or civil disturbance or government orders
  • A visa rejected/denied from any embassy / consulate.
  • Inability of the Student to meet any eligibility criteria of a particular University or course.
  • The Student did not attend or pass a personal/Skype interview of any kind carried out by a University.
  • Any student, for any reason, after paying the university fee or admission rolls up or into something else apart from MBBS.
  • No refund shall be paid towards Fees charged by the University as a result of Tuition fee, hostel fees and any other charges for a university in India or abroad before or after travelling.

5.2 Adjustments (Not Refunds)

Fees paid may be adjusted (not refunded) against other Services if:

  • The Company will credit the fees paid by a Student who registered for MBBS Abroad towards due India service charges if he/she decides to pursue Admission in MBBD India through the Company.
  • If any Student who has registered for MBBS India and later on pursues or takes the admission in MBBS Abroad via the Company then on receiving an application I ncase Company may adjust the fees already paid against applicable abroad processing charges.
  • Non-Refundable for Student registered before the NEET examination, if not qualified. The registration fee is waived in any case, but The Student may avail of the same for next year’s admissions with their admission.

5.3 Post-Dated Cheque Policy

Post-dated cheques submitted as part of the service agreement shall be claimed after successful admission of the Student in a medical college.

  • Admission via NEET, Correlating Exam (for any of the MBBS colleges): Result form along with a counseling form and result copy must be sent to respective collegeMention: admission is possible in any of the affiliated medical institution via all merit lists laid by each territorial boardThe NEET will refrain from returning 1 lakh each on cheque when the Parent has altered their beliefs at this time of allotment.
  • If the Student did not get admission even after all possible attempts, post-dated cheques would be mutually released only upon completion of all applicable rounds of counselling.
  • The onus for maintaining an adequate balance in the parents bank account on the date of cheque lies solely on the Parent. Any Dishonour Cheque will invoke Legal Procedure to be exercised in terms of applicable Law.

Obligations and Responsibilities

6.1 Obligations of the Student/Guardian

  • The Student/Guardian shall ensure that all information and documentation provided is accurate, complete, and true.
  • The Student/Guardian will need to safe keep all original documents including Passport, Visa, Academic Marksheets and Admission Letters etc.
  • The Student/Guardian shall abide by all relevant laws, regulations, and rules of the University for the Entirety of the period he/she is studying.
  • The Student/Guardian shall be fully responsible for the student conduct, behaviour and legal compliance throughout the entire study period Abroad/ India.
  • You may have seen · The Parent hereby acknowledge and agree that the parents/guardians will pay for all fiscal responsibilities of the Student for any fee towards their tuition, hostel charge, meal charge, publications required for us, study material etc.
  • The Parent shall bear all increase in tuition or other university fees due to inflation, currency depreciation or changes of University policies.
  • All expenses that are listed in foreign currencies (USD, EUR or otherwise) shall be paid at the current exchange rate on the date of incurring the expense.
  • The parent/s of the applicant reaffirm that they are well-informed and thoroughly acquainted with all rules, regulations and guidelines issued by the NMC & VCI including eligibility criteria, duration of course, internship or training before licensing examination or registration. They admit that their child is falling under degree course MBBS abroad on voluntary basis and will keep updating any further changes in NMC/VCI guidelines.
  • Parents note that the consultancy/company is not responsible and has no liability in any manner whatsoever for changes in or deviation from, NMC & VCI guidelines or non-adherence to them.
  • It is solely the duty of the candidate to obtain their digital and hard copies of NEET Score Card, Passport, Class 10th & 12th Mark Sheets, University Admission Letter and other Academic or Personal Identification documents.
  • Parents are aware that the only purpose of coming here to this country/university is education and shall fully be responsible for his/her (above person) behaviour during the whole duration of studies.
  • Parents shall solely be responsible for defending any court case occurring during the study period and not Ria Overseas Pvt. Ltd.
  • The students shall be solely liable for any attendance, academic performance, examination results, disciplinary action /suspension/termination or expulsion from any college/university. In no event shall Ria Overseas be liable in any way.

Limitation of Liability

The Company limits its liability to the maximum extent permissible by law as follows:

  • The Company is an educational consultancy with support services, and no admissions to any university college or course are guaranteed.
  • The Company does not guarantee or hold any responsibility and or liability of any decision that may be taken by any University, Government authority, Embassy/ Consulate, NMC, and VCI in respect to enabling these test.
  • The Company shall not be liable for delays, rejections or problems due to visa processing and other immigration procedures or decisions taken by relevant embassies / consulates.
  • The Company damages Student with respect to medical, legal, health or behaviour of the Student during his/her study period abroad.
  • Also the Company shall not take any responsibility if it is found that any/ all changes in NMC Guidelines, VCI Guidelines, University guidelines and Government policies affects Student’s eligibility for course choice and career.
  • The Company shall not be liable to you in respect of any indirect, special, consequential, or punitive damages arising out of or in connection with the Services.
  • Ria Overseas will not be responsible or liable for any such security deposit with colleges / universities in India or outside.
  • If such a student finally converts his/her candidature from General to NRI or any other category, then Ria Overseas shall not be responsible for any earlier registration made under the General Category.

Confidentiality and Data Protection

The Company will keep the Parent’s personal, academic and financial information confidential. Such information will only be used for the provision of the Services and will not be made available to a third party unless required by law or in accordance with clause 17.6 (where required to notify the Parent) without the prior written consent of the Parent.

By agreeing the Parent consents to the Company providing necessary information with Universities, Embassies, Government authorities and partner organisations only for the admission process.

Relationship of the Parties

Company is an independent education consultancy. Nothing in this Agreement is intended to or shall be construed to create any form of partnership, joint venture, agency, employment arrangement in relation to the Parent and the Company.

The Company shall only be a medium for facilitation and shall in no manner be entitled to bind any University, Government authority or Embassy for particular outcomes relating to the Parent.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed under the laws of India.

Any controversy, claim or dispute (hereinafter referred to as “disputes”) arising out of or related to this Agreement shall first be attempted to be settled amicably between the parties hereto through mutual negotiation within 30(thirty)days.

Disputes which cannot be amicably settled within thirty (30) days will be referred to arbitration as per Arbitration and Conciliation Act, 1996 The seat/venue of arbitration and exclusive jurisdiction shall be the courts where the corporate office of Ria Overseas Pvt. Ltd. is registered.

Amendments and Modifications

The Company has the sole and absolute discretion to change, amend or modify these Terms and Conditions at any time. Parent shall be communicated of any such amendments via the formal communication channels. Your continued use of the Services after being notified of any amendment means that you accept and will abide by such amended Terms.

Severability

If any provision of this Agreement is determined by a court of competent jurisdiction to be void, illegal or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision will be amended to the minimum extent necessary to render it valid and enforceable.

Entire Agreement

This Terms and Conditions document executed by the Student and their parents/guardians is the sole enforcement between both parties with the exception of prior negotiations that constitute representation, warranties or understandings of any nature.

Declaration

I/We have understood, accepted and agreed to the Terms and Conditions above, Refund Policy and all related terms contained herein. I / We declare that the above information is true to my / our best knowledge and belief.
